YDS Max | FZG Apps

Welcome to YDS Max ("App"), a mobile application developed and operated by FZG Apps ("we," "us," or "our"). By downloading, installing, accessing, or using YDS Max, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By creating an account or using the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy (https://www.fzgapps.com/applications/yds-max/privacy). We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will indicate the date of the latest revision at the top of this page.

2. Description of Service

YDS Max is an educational application designed to help users prepare for the YDS (Foreign Language Proficiency Exam for State Employees) English exam. The App provides:

- Practice exams in the official YDS format.

- Section-based practice covering vocabulary, grammar, translation, and reading comprehension.

- Detailed explanations, translations, and solutions for questions.

- Exam history and performance tracking.

The App is provided for educational and informational purposes only. We do not guarantee any specific exam results or outcomes.

3. Eligibility

You must be at least 13 years of age to use this App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet the eligibility requirements.

4. User Accounts

The App uses anonymous authentication to create a user session. You are not required to provide any personal information such as your name, email address, or phone number to use the App. Your anonymous account is linked to your device and is used solely to store your exam history and progress. You are responsible for maintaining the security of your device and account.

5. Acceptable Use

You agree to use the App only for its intended educational purpose. You shall not:

- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.

- Copy, modify, distribute, sell, lease, or sublicense any part of the App or its content.

- Use the App to develop a competing product or service.

- Attempt to gain unauthorized access to the App's servers, systems, or networks.

- Use automated scripts, bots, or other tools to access or interact with the App.

- Reproduce, redistribute, or commercially exploit exam questions, answers, explanations, or any other content provided by the App.

- Interfere with or disrupt the integrity or performance of the App or its infrastructure.

- Use the App in any manner that violates applicable laws or regulations.

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, questions, explanations, translations, graphics, logos, icons, software, and design, are the exclusive property of FZG Apps or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes in accordance with these Terms.

7. Exam Content Disclaimer

7.1 General Disclaimer

YDS Max is an independent educational application. It is not endorsed by, affiliated with, or connected to ÖSYM (Ölçme, Seçme ve Yerleştirme Merkezi / Assessment, Selection and Placement Center) or any government body. The term "YDS" is used solely to describe the subject matter of the App — preparation for the YDS (Foreign Language Proficiency Exam).

7.2 Original Content

The majority of questions, explanations, translations, and materials provided in YDS Max are originally created by FZG Apps for practice and educational purposes. These are not official YDS exam questions. While we strive to align content with the official exam format and difficulty level, we make no representations regarding the accuracy, completeness, or suitability of the content for actual exam preparation.

7.3 Past Exam Questions

The App includes a selection of questions sourced from past e-YDS examinations that have been publicly released by ÖSYM.

7.4 Exam Calendar

The App may display an exam calendar with estimated dates for upcoming YDS and e-YDS exams, including application periods and result announcements. These dates are provided for informational convenience only and may not reflect the most current or accurate schedule. We do not guarantee the accuracy, completeness, or timeliness of the calendar information. Users should always verify exam dates, application deadlines, and other scheduling details on the official ÖSYM website (www.osym.gov.tr). We shall not be liable for any reliance on the calendar information provided in the App.

8. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App. The App requires an internet connection to generate exams and practice questions. We do not guarantee uninterrupted or error-free operation of the App.

9. Updates

We may release updates to the App from time to time. Some updates may be mandatory and the App may require you to install them before continued use. You agree that such mandatory updates are part of the normal operation of the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FZG APPS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless FZG Apps and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Third-Party Services

The App uses third-party services to operate, including:

- Google Firebase — for authentication, cloud functions, and data processing. Your use of these services is also governed by Google's Terms of Service (https://policies.google.com/terms).

We are not responsible for the practices or policies of third-party service providers.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FZG Apps regarding your use of the App and supersede all prior agreements and understandings, whether written or oral.
